Cyber Security Litigation

According to a report by the Identity Theft Resource Center, the number of data breaches in the United States reached a record high in 2020, with a total of 1,108 reported breaches. This represents a 19% increase from the previous year.

Not surprisingly, the extent of cybersecurity litigation in the United States has increased significantly in recent years, as more businesses and organizations become victims of cyber-attacks. Some of the resultant litigation revolves around:

  • Data breach lawsuits: These are lawsuits brought by individuals whose personal information has been compromised in a data breach.
  • Cybercrime lawsuits: These are lawsuits brought by victims of cybercrime, such as hacking, phishing, or ransomware attacks.
  • Intellectual property lawsuits: These are lawsuits related to the theft or misuse of intellectual property, such as trade secrets or copyrighted material.
  • Regulatory actions: These are actions taken by government agencies, such as the Federal Trade Commission or the Department of Justice, to enforce cybersecurity regulations and hold companies accountable.
  • Overall, cybersecurity litigation in the United States is a complex and rapidly evolving area of law.

United ADR has one of the foremost experts in Cyber Security on their panel and prepared to help you navigate this most complex arena both through:

Post Dispute Resolution, or

Pre-Contract Negotiation or Analysis.

United can help in several ways.

1. Cyber Insurance policy terms negotiation between client firm(s), MSSPs and Insurers. We can help you identify and set clear definitions of covered incidents, coverage correlation with MMSPs offerings and negotiation of terms and contingencies with the insurance companies.

Let us help you avoid instances of coverage denials or other circumstances that will cause you coverage litigation or reduced coverage in the future. A proper analysis of both your Cyber Protection Contract in conjunction with your insurance coverage “shopping” will save you countless headaches in the future.

2. We can seamlessly set up Cyber Insurance claims arbitrations or mediations between two or more parties. United ADR will provide a combined neutral panel of Cyber and Legal Experts to bring you to resolution.

3. United can also provide Cyber Incident Coverage mediation. This is a complex process involving familiarization with the terms of the policy, client’s adherence to these terms, third-party definitions for MSSPs (by the insurer), and determination of due diligence by parties involved.

United will streamline this typically time-consuming process by structuring the discovery process, requests for clarification and production and substantiation of statements by all parties. The typical costs inherent in this process can be catastrophic, but with United we can make it both reasonable and practical.
